Power of Attorney Documents

Signing over power of attorney can be a major life decision. But too few people even recognized that they have this power of attorney to even sign over; that’s why it’s so important that before you even review power of attorney documents, you have some level of understanding about what you’re getting into.

First, you exercise you own power of attorney on a daily basis – whether you’re signing checks or even approving purchases. These daily routines are part of your legal rights as an individual. You do, after all, have the power to make your own decisions.

Next, you’ll have to realize how you might need checks to be signed in your name, for example, without actually being able to sign them yourself. For many people, this happens because of medical or health issues – but there are other circumstances which can require signing over power of attorney to someone else, such as being out of the country for an extended period of time.

Given the amount of power a power of attorney document, once signed, will grant to someone else, you have to make sure that your power of attorney is in the hands of someone you trust implicitly. Some people trust their lawyers implicitly, but it’s more likely that you’ll want to use your spouse or another family member in these cases.

In some power of attorney documents, such as living wills, you can actually authorize power of attorney for an individual in specific cases. If you become medical incapacitated, for example, your living will can stipulate who has the power of attorney to make your medical decisions for you – this is often known as medical power of attorney.

The more you learn about power of attorney documents, the more you’ll realize just how important they can be. Don’t sign any before you know what you’re getting into and you know that’s exactly what you want to do.
